Terms and Conditions

Introduction

These terms and conditions govern the provision of air conditioning installation, maintenance, and repair services (“Services”) by Thermo Pro (“Company”) to the client (“Client”). By engaging our Services, the Client agrees to be bound by these terms and conditions.

Services

The Company will provide the following Services:

• Air conditioning installations
• Air conditioning maintenance
• Air conditioning repairs for any make and model

The scope of work will be determined by the Company in consultation with the Client.

Fees and Payment

The fees for the Services will be as agreed upon between the Company and the Client.

Payment terms:

An 80% deposit is required before work commences. The outstanding 20% is due upon completion of the project. The deposit is non-refundable and serves as confirmation of the Client’s commitment to engage our services. Failure to pay the outstanding amount within 7 days of completion may result in additional fees and legal action to recover the outstanding amount. The Company reserves the right to suspend or terminate the services until payment is received in full. By engaging our services, the Client agrees to these payment terms.

In the event of non-payment, the Company reserves the right to suspend or terminate the Services.

Warranties and Liability

The Company warrants that the Services will be provided with reasonable care and skill. However, the Company shall not be liable for any loss or damage caused by circumstances beyond its control.

The Client is responsible for ensuring that the premises where the Services are to be provided are safe and free from hazards. The Company shall not be liable for any loss or damage caused by unsafe or hazardous conditions at the premises.

Intellectual Property

The Company retains all intellectual property rights in any materials or products created as part of the Services. The Client may use such materials or products solely for its internal purposes and shall not sell, distribute, or otherwise exploit them without the Company’s prior written consent.

Confidentiality

The Company and the Client shall each maintain the confidentiality of any information provided by the other party in connection with the Services. The Client shall not disclose any information regarding the Services to any third party without the Company’s prior written consent.

Termination

Either party may terminate the Services by providing written notice to the other party. In the event of termination, the Client shall pay the Company for all Services provided up to the date of termination.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising from or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.

Entire Agreement

These terms and conditions constitute the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties, whether written or oral.

By engaging the Services of Thermo Pro, the Client acknowledges that they have read and understood these terms and conditions and agrees to be bound by them.
